Eligibility
By placing an order with Fleur & Mae you confirm that you are at least 18 years of age, are legally capable of entering into a binding contract, and are using a valid payment method that belongs to you.
Your account
You may shop with us as a guest or by creating an account. If you create an account, you are responsible for keeping your login details confidential and for any activity that takes place under your account. Please contact us immediately if you believe your account has been used without your permission.
Orders and acceptance
When you place an order through the Site, you are making an offer to buy. We will send you an order confirmation by email — this is an acknowledgement that we have received your order, but does not yet form a contract.
A binding contract between us comes into existence only when we dispatch the goods and send you a dispatch confirmation. Until that point, we may decline an order — for example if an item is out of stock, if there is a pricing error, if we cannot verify your payment, or if the order appears suspicious.
Prices, taxes and currency
All prices on the Site are shown in pounds sterling (GBP) and include VAT at the prevailing UK rate where applicable.
Delivery charges, where applicable, are added at checkout before you pay.
While we take care to ensure prices are accurate, errors can occasionally occur. If we discover an error in the price of an item you have ordered, we will let you know and give you the option to either continue at the corrected price or cancel for a full refund.
Payment
Payment is taken at the point of order via the payment methods displayed at checkout. All transactions are processed by our payment providers under their own terms; Fleur & Mae does not store your full card details.
Delivery, risk and title
We aim to dispatch and deliver in line with the timescales set out in our Delivery & Shipping policy. Estimated delivery dates are guidance only, not guarantees.
Risk in the goods passes to you on delivery. Title (legal ownership) passes to you once we have received your payment in full and the goods have been delivered.
Cancellations, returns and refunds
Your rights to cancel, return, and receive a refund are set out in full in our Returns & Refunds policy, which forms part of these Terms.
Nothing in these Terms affects your statutory rights as a consumer in the United Kingdom.
Product information & natural variations
We work hard to ensure that product photographs, descriptions, dimensions, and specifications are accurate. However:
- Our artificial botanicals are individually crafted, so each piece may vary slightly in colour, shape, leaf placement, and stem positioning. These variations are part of the handcrafted character — not a fault.
- Colours displayed on screen depend on your device and lighting; small differences from the photographs are normal.
- Sizes are approximate and may vary marginally from the stated dimensions.
Stock availability
All orders are subject to availability. If an item becomes unavailable after you have ordered, we will contact you to offer an alternative or a full refund.
Intellectual property
All content on the Site — including but not limited to the Fleur & Mae name and logo, photography, illustrations, text, graphics, layout, and design — is owned by us or our licensors and is protected by intellectual property laws.
You may view, print, and download content from the Site for your own personal, non-commercial use only. You may not copy, reproduce, modify, republish, or commercially use any part of the Site or its content without our prior written permission.
User content
If you submit reviews, photographs, comments, or other content to the Site, you confirm that the content is your own, accurate, and does not infringe anyone else's rights. By submitting content, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and display it in connection with our business — including in marketing materials, on social media, and on the Site itself.
We reserve the right to remove any user content that we consider inappropriate, offensive, or unlawful.
Acceptable use
You agree not to:
- Use the Site for any unlawful or fraudulent purpose
- Place orders using false or stolen payment information
- Attempt to interfere with the security or operation of the Site
- Scrape, harvest, or extract data from the Site without our written permission
- Use automated tools (bots, scripts, spiders) to access the Site for any purpose other than indexing for search engines
Privacy
Your privacy matters to us. The way we collect, use, and protect your personal information is set out in our Privacy Policy.
Our liability
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be limited or excluded by law
Subject to the above, our total liability to you in connection with any order is limited to the price you paid for the goods that gave rise to the claim. We are not liable for any loss of profit, loss of business, business interruption, or loss of business opportunity.
If you are a consumer, this clause does not affect your statutory rights.
Events outside our control (force majeure)
We will not be liable for any delay or failure to perform our obligations where the cause is outside our reasonable control — including (without limitation) acts of God, severe weather, fire, flood, strikes, pandemics, transport disruption, or supplier failure. We will let you know as soon as practicable and either resume performance once the event has passed or, where appropriate, give you the option to cancel for a refund.
Changes to these Terms
We may update these Terms from time to time to reflect changes in law, our products, or our business. The version that applies to your order is the version in force at the moment you place that order. The current version is always available on the Site.
Termination
We may suspend or close your account, or refuse to accept future orders, if you breach these Terms or if we reasonably suspect fraudulent activity.
Severability
If any part of these Terms is found by a court to be unenforceable, the remaining provisions will continue in full force.
Governing law and jurisdiction
These Terms and any dispute arising out of them are governed by the laws of England and Wales. Both you and we agree to the non-exclusive jurisdiction of the courts of England and Wales — though if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
